Tinjauan Kritis UU Cipta Kerja Sektor Lingkungan Hidup: Reaktualisasi Pancasila Guna Memperkokoh Ketahanan Nasional

Pancasila sebagai philosophische grondslag seharusnya menjadi kompas moral dalam setiap pengambilan kebijakan, terutama terkait lingkungan hidup. Namun kenyataannya, terdapat kesenjangan antara idealitas nilai Pancasila dengan realita. Penelitian ini bertujuan untuk menganalisis konstruksi filosofis Pancasila sebagai landasan etika lingkungan, serta dampak disharmoni regulasi pasca Undang-undang Cipta Kerja terhadap ketahanan nasional. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan terutama UU Cipta Kerja dan UUPPLH, serta pendekatan konseptual Green Constitution, Demokrasi Lingkungan, Keadilan Antargenerasi, Precautionary Principle dan Ketahanan Nasional. Hasil penelitian mengungkapkan adanya pelemahan hukum lingkungan pasca UU cipta kerja yang berimplikasi pada kerentanan ketahanan nasional. Yaitu kegagalan ekologis dalam Perizinan Berusaha Berbasis Risiko (PBBR); dekonstruksi asas strict liability; pengebirian pilar demokrasi lingkungan; kekosongan pengawasan akibat sentralisasi kewenangan; serta hilangnya efek jera akibat dominasi sanksi administratif (administrative penal law). Diperlukan reaktualisasi nilai Pancasila melalui penegakan hukum integratif, dimana sanksi pidana diposisikan sebagai primum remedium untuk kejahatan lingkungan berat, merestorasi hak gugat dengan asas strict liability, serta mendesentralisasikan kembali tata kelola lingkungan hidup.
